Dear Colleagues,
This letter is to inform you that the Government Decree of the Russian Federation of December 10, 2008 «On Approval of Regulations for Patent and other fees on fulfillment of legally significant actions connected with Invention, Utility model, Industrial Design Patents, State Registration of Trade Mark and Service Mark, State Registration and Granting Exclusive Rights to Appellations of Origin, and also State Registration of Assignment Deeds and Agreements on Disposal of these Rights» came into force on December 30, 2008.
According to the above Regulations since December 30, 2008 Official fees have been changed: -
- For residents the Official Fees have been increased twice in comparison with the Regulations on Official fees No. 793 of 12.08.1993;
- For non-residents the Official Fee is defined in Rubles (earlier payment currency was US dollar)
- a non-resident-applicant having a constant residence or a constant place a finding on the territory of the Contracting State of the Paris Convention and thus the level of the gross revenue per capita is 3000 US dollars and less pays 25 % of Official fee for registration of Applications, carrying out examination and obtaining patents
- New Official Fees are established for:
- recognition of conventional priority right on Invention Application according to the applicant’s request;
- publication of a judgment on infringement of patent rights in the official bulletin (on patent holder request);
- preparation, certifying and issuing of patent copies, materials of Application;
- carrying out examination of Design Application and decision-making based on its results;
- Official Fees Payment terms have been changed for:
- substantive examination of Invention Application (payment for examination of one independent claim, from 2 to 10, and in excess of 10);
- registration of Industrial Design Application (additional Official Fee was paid for each 5th version, now for each version in excess of one);
- and also for registration of Assignment Deeds and Agreements on Disposal of these Rights: Official Fees have been increased by 1500-2000 Rubles.
